AmCham China White Paper: China’s IP protection climate witnesses ongoing improvement

    In the past ten years, China has made outstanding achievements in IP protection system, and more and more American businesses believe that China’s IP protection environment is improving, according to American Business in China White Paper published by the American Chamber of Commerce in China (AmCham China)in Beijing.

    Chinese market is leading in emerging technology adoption, including AI, 5G and autonomous driving. According to the previously released 2020 Business Climate Survey, in 2019, some 69% respondents reported China’s enforcement of IPR improved in 2019, compared to 58% in 2018. These results are consistent with high-level statutory commitments by the Chinese government to continue improving the system for IPR made throughout 2019. The Foreign Investment Law Implementing Regulations include provisions for the creation of an IPR dispute mechanism and a punitive damages mechanism to improve enforcement of IPR, according to the White Paper.

    AmCham China has witnessed progresses in IP protection made by China. In 2019, China had completed the reorganization of the former State Intellectual Property Office, and set up an IP Tribunal within the Supreme People’s Court. The General Office of the CPC Central Committee and the General Office of the State Council jointly issued the Opinions on Strengthening the Protection of Intellectual Property Rights. AmCham China appreciated the above measures China has made and wish they can bolster enforcement and efficiency of IP laws and regulations and step up consistency and transparency of IP Court in the course of hearing, according to the White Paper.

    The White Paper is the 22nd annual paper of its kind published by AmCham China, providing a comprehensive analysis targeting different industries to advise the Chinese and the U.S. governments. AmCham China is a non-profit and non-government organization with over 4,000 members.
